About This Case
This cause arose from a petition for injunction for
protection against stalking that appellee filed against her former
boyfriend. The trial court entered a temporary
injunction and set for evidentiary hearing the
matter of whether a final injunction should be
imposed. The former boyfriend did not appear at the hearing
but the appellee did. The trial court heard her
testimony and entered a final judgment of
injunction, which the boyfriend did not appeal. Instead, he retained counsel and filed a
motion for relief from judgment pursuant to
Florida Rule of Civil Procedure 1.540(b)(1).

The trial court was reversed for failing to allow the client from presenting evidence why he did not appear at the hearing that resulted in an adverse ruling.
